Planning - tree preservation orders: Outline
The Town and Country Planning Act 1971 gives Local Planning Authorities the power to safeguard trees, or groups of trees, which they consider make a significant contribution to the amenity of an area, by serving a Tree Preservation Order (TPO).
A TPO is served in relation to a property and constitutes a land charge on that property, binding on all subsequent owners and occupiers. Once an order has been made, written permission is required from the local planning authority for any works to the tree.
