Unlike other strands of discrimination legislation, both direct and indirect age discrimination may be capable of objective justification i.e. where action taken:

Fulfils a "legitimate aim"; and is a "proportionate means" of achieving that aim i.e. it is appropriate and necessary in the particular circumstances.
