Q: Safeguarding Issues - In regard to ASTs or Outreach Teachers, are the schools that allow these teachers into their schools required to do a CRB check, or is the employing school’s CRB check sufficient?

Q: Safeguarding Issues - We have been told to take copies of passports, driving licences and utility bills to verify a person’s identity. Is this necessary?

Answer:

The DCSF Guidance, para 4.13 states that an employer must ask to see proof of identity such as birth certificate, driving licence or passport, combined with evidence of address, before an appointment is made. It makes no reference to taking or keeping duplicate copies of these documents. However, the UK Border Agency stipulates that, in order for employers to comply with the 'Asylum & Nationality Act, 2006' (which came into force on 29th Feb 2008) and avoid civil penalties, a school is strongly recommended (words in guidance to the law) to make photocopies of identity documents and retain these documents whilst the employee is with the school and for up to two years following their departure. This is not a legal requirement, but if the photocopies cannot be produced on inspection by the UK Border Agency it will make the employer liable to civil penalties. This was apparently the case with Baroness Scotland that was in the press recently.

When employing someone from outside the European Economic Area (EEA) with limited right to remain in the UK, schools are strongly recommended to renew the checks and take photocopies every 12 months.

It would be advisable, when making copies, to do so in black and white as this would ensure there is no danger of the copies being seen to be forgeries, although the copies still need to be clear.
 
In terms of the Data Protection Act, the Information Commissioners Office (ICO) has confirmed that there appears to be no contravention of the Act by the UK Border Agency in requesting copies of identity documents as the request appears 'reasonable'. The ICO refer to Principle 3 - that the request is adequate, relevant and not excessive, and Principle 5 - that the information is not kept for longer than necessary.

She has recently qualified as a teacher and I am going to employ her to do one to one tuition. I have been told that she must have a new CRB check as she is changing her role. How is this safeguarding children?
