SPD 2 - Planning Obligations - A Guide to Section 106 & Developer Contributions
The Planning Obligations Supplementary Planning Document (SPD) will form part of the Southend on Sea Local Development Framework (LDF). The LDF is a set of development plan documents (DPDs) and supplementary planning documents (SPDs) that together form the planning policy framework for the town. Together with other relevant LDF documents, this SPD will be taken into consideration when planning applications are considered by the Council.
The purpose of this document is to provide developers, landowners, the community and the Council with guidance in relation to potential planning obligations or developer contributions in relation to development. The document also includes procedural information and contact details to assist in the negotiation of legal agreements.
This SPD adheres to a fundamental principle that planning permission may not be bought or sold but will ensure that development will be sustainable. The document outlines how the Council, through the Section 106 process, will seek to deliver a range of infrastructure, services and facilities related to the impact of new development. These are addressed under the Southend on Sea "Sustainable Communities Criteria".
A Sustainability Appraisal report, assessing the sustainability implications of the SPD, has been produced for public consultation alongside the consultation draft of the Planning Obligations SPD.
