Penalty charge notice discretionary policy

The enforcement and cancellation of Penalty Charge Notices (PCNs) must:

  • follow the enforcement process
  • comply with the Traffic Penalties Tribunal
  • comply with the Local Government Ombudsman

Courts understand that councils need to be flexible when making decisions, and they shouldn't be forced to follow strict rules all the time.

We have created this policy so that when we deal with PCNs we follow best practice and are:

  • clear
  • consistency
  • fair
  • open

We designed this policy to guide:

  • the public
  • council employees
  • contractors working within parking enforcement.
