Highway enforcement

The Highways Act 1980 contains provisions enabling us the Highway Authority for the Borough to deal with “various encroachments, obstructions, and unlawful interferences”. Each provision prescribes actions that a Highway Authority may take. Common Law also exists to enable the Highway Authority to remove or reduce obstructions and nuisances under the same act.

We prioritise the enforcement of these to protect the use and enjoyment of the highway for the public. This is explained fully in our Highways Enforcement Policy, it covers the actions that we will consider when undertaking enforcement.

We believe in a firm, but fair regulation and where a defect has been discovered by Officers or where it has been reported by members of the public, this policy will be used to ensure the highway remains safe for the public.
