Operational permit terms and conditions

This document sets out the terms and conditions for operational permits. The Council reserves the right to revise, withdraw or cease issuing any permit type or introduce a new permit type as and when required.

Eligibility

  • Public Sector bodies undertaking regular work in the community which requires the use of a vehicle, or private sector organisations offering these services on behalf of a Public Sector body

  • approval is entirely at the discretion of the Council

Permitted vehicle type

  • permits are only valid for use that meet the following criteria: -
    1. passenger carrying vehicle with capacity to carry no more than 8 passengers, excluding the driver
    2. light goods vehicle
  • in all cases, the vehicle overall height must not exceed 2.3 metres, and the length must not exceed 5.5 metres
  • where parking spaces are marked, the vehicle must comfortably fit within the markings, without overhanging

Use and validity

An operational permit is only valid for use in the designated location(s) associated to the permit type/ colour-code that has been issued:

  1. Operational Permit (Yellow) - This is a virtual permit, valid for up to 4 hours parking within a residential parking permit scheme area or at on-street pay-by-phone/ pay and display bays operated by Southend City Council.
  2. Operational Permit (Pink) - This is a virtual permit, valid for up to 6 hours parking within a residential parking permit scheme area or at on-street pay-by-phone/ pay and display bays operated by Southend City Council.
  3. Operational Permit (Black) - This is a printed permit that is transferable between vehicles and must be displayed on the dash or fascia of the vehicle when in use. It is valid for up to 4 hours parking within a residential parking permit scheme area or at on-street pay-by-phone/ pay and display bays operated by Southend City Council.
  4. Operational Permit (Silver) - This is a virtual permit, valid for up to 6 hours parking within a residential parking permit scheme area or at on-street pay-by-phone/ pay and display bays operated by Southend City Council as well as Council-managed car parks (except the following car parks - Civic Underground, Civic East, Civic North (surface), Beecroft Lower, Beecroft Upper and Baxter Avenue)
  • only one vehicle registration can be linked to a permit, except Operational Permit (Black) which is issued as paper permit
  • permits are not valid for parking in bays signed or marked for a specific requirement such as, but not exclusively, disabled bays, loading bays, suspended bays or other permit-specific bays
  • permits are not valid for use in suspended parking bays
  • the vehicle MUST be moved if instructed to by a Police Officer, Civil Enforcement Officer or authorised Council officer in pursuit of their duties or where it is believed that an obstruction is being caused or for safety reasons. Failure to do so may result in the vehicle being issued a Penalty Charge Notice and removal at your expense
  • vehicle parked by virtue of a permit, must not be used for any of the following purposes:
  1. the sale, or the offering for sale of a vehicle

  2. the sale, or purchase of goods or services

  3. as accommodation, including sleeping, camping, cooking within or near to the vehicle, or for any commercial activities outside of the vehicle

  • apermit is only valid when all terms and conditions are met and where no other parking contravention has been committed

  • where any of the terms and conditions are not met, the permit will be invalid, and a Penalty Charge Notice (PCN) may be issued

Fraud and misuse

  • the Council reserves the right to undertake random eligibility checks at any time, and you may be requested to present proof of eligibility for the permit type you applied for
  • no photocopies or adaptions of Operational Permit (Black) is allowed, as such cases will be considered to be fraudulent, and a Penalty Charge Notice may be issued
  • the Council may revoke a permit if found to have been applied for fraudulently, through false statement or documentation. Where a permit is revoked, refunds will not be given, and disciplinary actions may be taken by the Council

Data Protection

The Council reserves the right to use data captured on the application form in line with the policy for General Data Protection Regulations, pursuant to permit administration.

Disclaimer

  • the Council accepts no responsibility for:
  1. the security of either vehicles or their contents and recommends vehicles are empty when parked, before leaving a vehicle you must ensure it is locked, that windows and any sunroof is securely closed and that no valuable possessions are left on display
  2. loss or damage caused to vehicles parked in any on the roadside or car parks

Declaration

When submitting an application, the applicant is accepting of all these terms and conditions of use.

Review

The Council reserves the right to amend these terms and conditions after giving notice to the permit holder of not less than 28 days.
